Terms of service

Article 1: Scope / applicability

1.1 These general terms and conditions apply to all agreements, deliveries, and other distance services concluded between the customer and Atelier Biru.
1.2 By placing an order, the customer accepts these terms and conditions, which are binding.
1.3 Unless otherwise agreed in writing by Atelier Biru, the customer's own terms and conditions are not accepted.

Article 2: Conclusion of the agreement

2.1 Atelier Biru will confirm the customer's order by email. A contract is concluded only once payment has been successfully processed. Atelier Biru reserves the right to refuse an order or to apply special conditions to an offer, without stating reasons. If Atelier Biru is unable to verify the customer’s provided address, the order may not be accepted.
2.2 Ordering processes that are interrupted for any reason before the payment instructions are completed are considered incomplete, even if the customer has received an order confirmation. Such orders will generally not be processed. Atelier Biru will attempt to contact the customer to complete the payment and enable delivery.

Article 3: Prices and charges

3.1 Prices are subject to change without prior notice.
3.2 The contract price is the price valid at the time of purchase.
3.3 Product prices include 21% btw (Dutch sales tax, where applicable). Prices exclude shipping fees and any additional charges. These costs are calculated during the checkout process and displayed in the payment summary.
3.4 Atelier Biru is not bound by its offer in the event of printing, typographical, or programming errors on the website. In such cases, Atelier Biru reserves the right to cancel the order and refund any payments made.

Article 4: Fulfilment of orders

4.1 Atelier Biru exercises the utmost care in processing orders.
4.2 Products will be delivered to the address provided by the customer.
4.3 Accepted orders will be shipped as quickly as possible, in the order they are received.
4.4 Any delivery times stated on the website are indicative only and do not entitle the customer to compensation in case of delay.

Article 5: Customs, duties, and taxes

5.1 When ordering from www.atelierbiru.com, the recipient becomes the importer and must comply with all applicable laws and regulations of the destination country. The customer is responsible for ensuring that the product may be lawfully imported. Orders shipped to countries outside the European Union may be subject to import duties, customs fees, and taxes levied by the destination country. All customs duties, VAT, and import fees are the responsibility of the buyer.
5.2 Atelier Biru advises customers to contact their local customs office for detailed information prior to placing an order. Atelier Biru has no control over such charges and cannot predict their amount.

Article 6: Right to return items

6.1 Customers have the right to return an item. Within the Netherlands and the EU, a customer may return an order within 14 days of delivery without giving a reason. Returned items must be in the same condition as received, unworn or unused, with tags (if applicable), and in the original packaging. A proof of purchase is required.
6.2 Shipping costs are non-refundable and are borne by the customer, including any costs for replacement items. Any fees paid for importing goods outside the EU or importing a replacement item will not be reimbursed by Atelier Biru. These costs are the customer's responsibility.
6.3 Atelier Biru reserves the right to refuse returned items. Items will be returned to the customer if they show signs of use or damage caused by the customer, or if the return does not comply with Atelier Biru’s return instructions.
6.4 If, for any reason, Atelier Biru fails to deliver within thirty (30) days without further notice, the customer is entitled to a full refund of the invoice amount without additional charges.

Article 7: Incorrect delivery and unclaimed shipments

7.1 If Atelier Biru delivers an item that differs from the order or arrives damaged or defective, the customer must notify Atelier Biru by email (info@atelierbiru.com) within 24 hours of receipt. Atelier Biru will refund the purchase price. If requested, return shipping costs will be borne by Atelier Biru.
7.2 The customer is responsible for providing a correct shipping address during the order process. If an incorrect address results in the parcel being returned to Atelier Biru, any additional shipping costs for re-delivery will be charged to the customer.
7.3 Items that are unclaimed by a customer and returned to our studio will not be reshipped unless all incurred fees are paid for by the customer.

Article 8: Payment

8.1 Customers may pay using the methods offered on the website, which may vary by country.
8.2 All payments must be made in accordance with the instructions provided on the website.

Article 10: General

Atelier Biru reserves the right to amend these terms and conditions at any time. Changes take effect immediately upon publication.

Article 11: Product information

11.1 All designs are the property of Atelier Biru and may not be reused without explicit permission.
11.2 All images, photographs, drawings, and data regarding weights, dimensions, colours, etc. on Atelier Biru’s website are approximate, for indicative purposes only, and may not give rise to claims for damages or termination of the agreement.

Article 12: Product availability

Although product availability may be indicated on the website, it cannot be guaranteed for immediate delivery. Atelier Biru reserves the right to revise, discontinue, or withdraw products without liability or prior notice and to cancel orders accordingly.

Article 13: Intellectual property

All designs, drawings, calculations, descriptions, photographs, models, and other materials or performances created or provided by Atelier Biru remain its intellectual property.
Images of our products may be used on personal blogs and social media channels, provided that Atelier Biru is credited as the source with a link to our website: www.atelierbiru.com.
